เงื่อนไขการใช้บริการ (Terms of Service)
1. ข้อมูลทั่วไป
1.1 เว็บไซต์นี้เป็นแพลตฟอร์มกลางเพื่อให้ผู้ใช้งานสามารถจำหน่ายและซื้อขายไฟล์ดิจิทัล เช่น ภาพ วิดีโอ เพลง โมเดล 3D เอกสาร และไฟล์ประเภทอื่น ๆ
1.2 การใช้เว็บไซต์ถือว่าท่านยอมรับเงื่อนไขการใช้บริการฉบับนี้
2. การลงทะเบียนและบัญชีผู้ใช้งาน
2.1 ผู้ใช้ต้องให้ข้อมูลที่ถูกต้องและเป็นจริงในการลงทะเบียน
2.2 เจ้าของเว็บไซต์ขอสงวนสิทธิในการระงับหรือยกเลิกบัญชีที่ฝ่าฝืนเงื่อนไขใด ๆ
3. ลิขสิทธิ์และทรัพย์สินทางปัญญา
3.1 ผู้ขายต้องรับรองว่าไฟล์ที่นำมาจำหน่ายเป็นทรัพย์สินทางปัญญาของตนเอง หรือได้รับสิทธิในการจำหน่ายอย่างถูกต้องตามกฎหมาย
3.2 หากมีการร้องเรียนเรื่องการละเมิดลิขสิทธิ์ ไฟล์ดังกล่าวจะถูกลบออกทันทีโดยไม่ต้องแจ้งล่วงหน้า และบัญชีผู้ขายอาจถูกระงับ
3.3 ผู้ขายเป็นผู้รับผิดชอบต่อความเสียหายที่เกิดจากการละเมิดลิขสิทธิ์แต่เพียงผู้เดียว
4. ความรับผิดชอบของเว็บไซต์
4.1 เว็บไซต์เป็นเพียงสื่อกลางเท่านั้น มิได้มีส่วนเกี่ยวข้องกับเนื้อหาหรือไฟล์ที่ผู้ขายนำมาลง
4.2 เจ้าของเว็บไซต์จะไม่รับผิดชอบต่อความเสียหายใด ๆ ที่เกิดจากการใช้งานเว็บไซต์หรือการซื้อขายระหว่างผู้ใช้
5. การเก็บข้อมูลส่วนบุคคล (PDPA)
5.1 เว็บไซต์จะเก็บและใช้ข้อมูลส่วนบุคคลตามความจำเป็น เช่น อีเมล ไอพี และข้อมูลการใช้งาน เพื่อการให้บริการ
5.2 ข้อมูลจะถูกเก็บรักษาอย่างปลอดภัย และจะไม่ถูกเปิดเผยแก่บุคคลที่สามโดยไม่ได้รับความยินยอม
6. เนื้อหาผิดกฎหมาย
6.1 ห้ามผู้ใช้โพสต์หรือจำหน่ายเนื้อหาที่ผิดกฎหมาย เช่น ลามกอนาจาร การพนัน ความรุนแรง หรือเนื้อหาที่ละเมิดสิทธิของผู้อื่น
6.2 หากพบเนื้อหาดังกล่าว เว็บไซต์จะลบทันที และอาจดำเนินคดีตามกฎหมาย
7. ค่าธรรมเนียมและรายได้
7.1 ผู้ใช้ตกลงว่าแพลตฟอร์มมีสิทธิ์เรียกเก็บค่าธรรมเนียมจากยอดขายที่เกิดขึ้นผ่านระบบของแพลตฟอร์ม
อัตราค่าธรรมเนียมที่ใช้บังคับจะแสดงไว้อย่างชัดเจนในหน้าข้อมูลการใช้งาน และอาจแตกต่างกันตามประเภท
ของผลิตภัณฑ์หรือบริการ
7.2 แพลตฟอร์มขอสงวนสิทธิ์ในการเปลี่ยนแปลงอัตราค่าธรรมเนียม หรือเงื่อนไขการเรียกเก็บเงินได้ตามดุลยพินิจ
อย่างไรก็ตาม การเปลี่ยนแปลงดังกล่าวจะมีการแจ้งล่วงหน้าอย่างน้อย 7 วัน ผ่านช่องทางที่เหมาะสม เช่น
หน้าเว็บไซต์หรืออีเมล หากผู้ใช้ยังคงใช้งานแพลตฟอร์มต่อไปหลังการเปลี่ยนแปลงดังกล่าวถือว่าเป็นการยอมรับเงื่อนไขใหม่โดยปริยาย
หากผู้ใช้ไม่เห็นด้วยกับการเปลี่ยนแปลงดังกล่าว ผู้ใช้สามารถยกเลิกการใช้งานหรือขอปิดบัญชีได้โดยไม่มีค่าใช้จ่ายเพิ่มเติม
7.3 ผู้ขายต้องรับผิดชอบในการยื่นภาษีเงินได้ตามที่กฎหมายกำหนด
8. การเปลี่ยนแปลงเงื่อนไข
8.1 เว็บไซต์ขอสงวนสิทธิในการเปลี่ยนแปลงเงื่อนไขโดยไม่ต้องแจ้งล่วงหน้า
8.2 การใช้บริการหลังจากการเปลี่ยนแปลงถือว่าท่านยอมรับเงื่อนไขใหม่
9. การชำระเงิน
9.1 ผู้ซื้อสามารถชำระเงินได้ผ่านช่องทางที่เว็บไซต์รองรับ เช่น PromptPay, บัตรเครดิต, หรือสกุลเงินดิจิทัล (Cryptocurrency) เฉพาะกรณีที่ไม่ขัดต่อกฎหมายของประเทศที่เกี่ยวข้อง
9.2 การชำระด้วยสกุลเงินดิจิทัลสงวนไว้สำหรับผู้ใช้งานที่อยู่ต่างประเทศเท่านั้น โดยผู้ใช้ตกลงและรับรองว่าเป็นผู้รับผิดชอบต่อความถูกต้องและความชอบด้วยกฎหมายของการทำธุรกรรมของตนเอง
9.3 เว็บไซต์ไม่รับผิดชอบต่อความเสียหายที่เกิดจากการแปลงค่าเงิน ค่าธรรมเนียมเครือข่าย หรือการผิดพลาดของกระเป๋าเงินดิจิทัลของผู้ใช้
10. อายุผู้ใช้งาน
ผู้ใช้งานต้องมีอายุอย่างน้อย 18 ปีบริบูรณ์ หรือได้รับความยินยอมจากผู้ปกครอง หากพบว่ามีการละเมิด เว็บไซต์มีสิทธิระงับบัญชีทันที
11. ข้อมูลส่วนบุคคลเพิ่มเติม (PDPA)
11.1 ผู้ใช้สามารถขอเข้าถึง แก้ไข หรือลบข้อมูลส่วนบุคคลของตนได้ โดยติดต่อผ่านช่องทางที่ระบุในเว็บไซต์
11.2 เว็บไซต์จะดำเนินการตามคำขอของผู้ใช้ภายในระยะเวลาที่สมเหตุสมผลตามกฎหมาย
12. ความปลอดภัยของไฟล์
เว็บไซต์ไม่รับประกันว่าไฟล์ทั้งหมดจะไม่มีไวรัสหรือข้อผิดพลาดอื่น ๆ ผู้ซื้อควรตรวจสอบไฟล์ด้วยโปรแกรมป้องกันไวรัสก่อนใช้งาน
13. การจ่ายเงินให้กับผู้ขาย
13.1 รายได้จากการขายสินค้าจะถูกโอนเข้าสู่บัญชีกลางของแพลตฟอร์มก่อน และจะโอนเข้าบัญชีของผู้ขายตามรอบการจ่ายเงินซึ่งจะดำเนินการทุกสัปดาห์
13.2 ก่อนการโอนเงิน แพลตฟอร์มจะทำการหักค่าธรรมเนียมตามที่ระบุไว้ในเงื่อนไขข้อ 7
13.3 ผู้ขายต้องระบุข้อมูลบัญชีที่ถูกต้องสำหรับการโอนเงิน หากมีข้อผิดพลาดในการโอนที่เกิดจากข้อมูลของผู้ขาย แพลตฟอร์มจะไม่รับผิดชอบ
13.4 การโอนเงินจะดำเนินการเฉพาะยอดรายได้ที่ถึงเกณฑ์ขั้นต่ำที่ระบบกำหนด หากยอดยังไม่ถึง จะสะสมไว้ในรอบถัดไป
Terms of Service (English)
1. General Information
1.1 This website is a digital marketplace that allows users to sell and purchase digital files such as images, videos, music, 3D models, documents, and other file types.
1.2 By using the website, you agree to these Terms of Service.
2. Registration and User Accounts
2.1 Users must provide accurate and truthful information when registering.
2.2 The website reserves the right to suspend or terminate any account that violates these terms.
3. Copyright and Intellectual Property
3.1 Sellers must ensure that the digital content they upload and sell is their own intellectual property or that they have proper legal rights to distribute it.
3.2 Upon receipt of a copyright complaint, the related file will be removed immediately without prior notice. The seller’s account may also be suspended.
3.3 The seller shall bear sole responsibility for any damage caused by copyright infringement.
4. Website Liability
4.1 The website acts as a platform only and is not involved in the content uploaded or sold by users.
4.2 The website shall not be liable for any damages arising from the use of the site or from transactions between users.
5. Personal Data (PDPA Compliance)
5.1 The website collects and uses personal data such as email, IP address, and usage logs only for service purposes.
5.2 All data will be securely stored and not disclosed to third parties without consent.
6. Prohibited Content
6.1 Users are strictly prohibited from uploading or selling content that is illegal, including but not limited to pornography, gambling, violence, or content that infringes on others' rights.
6.2 Any such content will be removed immediately, and legal action may be taken.
7. Fees and Earnings
7.1 Users agree that the platform reserves the right to collect service fees from sales made through the platform.
The applicable service fee rates will be clearly displayed on the relevant service information page and may vary depending on the type of products or services offered.
7.2 The platform reserves the right to modify the service fee rates or billing terms at its sole discretion. However,
any such changes will be communicated to users at least 7 days in advance through appropriate channels,
such as the website or email. Continued use of the platform after such changes take effect constitutes acceptance of the revised terms.
If a user does not agree with the updated fees or terms, they may discontinue the use of the service or request account closure without additional charges.
7.3 Sellers are responsible for reporting and paying income taxes as required by law.
8. Terms Update
8.1 The website reserves the right to modify these terms at any time without prior notice.
8.2 Continued use of the service after changes are made constitutes acceptance of the new terms.
9. Payments
9.1 Buyers may use supported payment channels such as PromptPay, credit cards, or cryptocurrency (where legally permitted).
9.2 Cryptocurrency payments are limited to users outside of Thailand. Users agree to be solely responsible for the legality of their transactions.
9.3 The platform is not liable for issues related to currency conversion, network fees, or wallet errors.
10. User Age
Users must be at least 18 years old or have parental consent. Accounts violating this policy may be suspended immediately.
11. Additional Personal Data Rights (PDPA)
11.1 Users may request to access, edit, or delete their personal data by contacting the platform through the provided channels.
11.2 Requests will be processed within a reasonable timeframe as required by law.
12. File Safety Disclaimer
The platform does not guarantee that all files are free from viruses or other errors. Buyers are advised to scan all files before use.
13. Seller Payment
13.1 Revenue from sales will first be held in the platform’s central account, then transferred to the seller on a weekly payout schedule.
13.2 Before payout, the platform will deduct applicable service fees as specified in section 7.
13.3 Sellers must provide accurate bank or wallet details for receiving payouts. The platform is not liable for payment issues resulting from incorrect information.
13.4 Payouts will only be made once the minimum earnings threshold is met. Earnings below the threshold will roll over to the next cycle.
